SRINAGAR, AUGUST 09: Labour and Employment (L&E) Department has notified an amended inspection manual to have a conducive ecosystem for investments for economic development of the State and to ensure inspections are objective, unambiguous and transparent and accountable in nature.
The notified comprehensive ‘J&K Inspection Manual for Compliance of Labour Laws’ carries a detailed list of instructions to be undertaken for rationalization of inspections under the Labour laws.
According to the inspection manual, there shall be no surprise inspections, except in case of emergency. Only scheduled inspections are to be carried out, depending upon industrial safety and Labour parameters. The scheduled inspection is to be formulated by Labour Commissioner/Chief Inspector through computerized randomly generated system, quarterly, one month in advance for every quarter. “This schedule shall be available on the official web portal wwwjklabour.com and can be downloaded by anyone,” the manual reads.
While as non-hazardous/low risk/green category units are exempted from physical inspections provided such units furnish the inspection reports annually, on the basis of self-certification.
The inspection shall be done by a team of inspectors only and report would be uploaded within 48 hours from the date of completion of inspection on the www.jklabour.com portal.
Whereas, no piecemeal, but joint/combined inspection is to be conducted for all labour Acts applicable to a unit, simultaneously.
Furthermore, medium risk units shall have an option of third-party certification/audit, besides special inspections would be carried out in case of accidents/emergency.
